Terms of Service for Deen Buddy

Welcome to Deen Buddy! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Deen Buddy ("Company," "we," "us," or "our").

By accessing, downloading, or using the Deen Buddy mobile application (the "App") or our related services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE APP.

1. Account Registration and Security

  • Eligibility: You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian’s permission to use the App.

  • Account Credentials: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. Deen Buddy is not liable for any loss or damage arising from your failure to protect your account.

2. Intellectual Property and License

  • Ownership: The App, including but not limited to its source code, design, text, graphics, logos, and features, is the exclusive property of Deen Buddy and its licensors. It is protected by copyright, trademark, and other intellectual property laws.

  • Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for your personal, non-commercial use solely as permitted by these Terms.

  • Restrictions: You may not:

    • Copy, modify, or create derivative works based on the App.

    • Reverse engineer, decompile, or attempt to extract the source code.

    • Use the App for any commercial purpose without our express written consent.

    • Use any automated system (robots, spiders, scrapers) to access the App.

3. Religious Content Disclaimer

Please read this carefully. Deen Buddy provides religious content, including prayer times, Qibla direction, and Quranic text, for educational and spiritual purposes.

  • Calculation Methods: Prayer times and Qibla direction are calculated based on mathematical algorithms and your device's location sensors. While we strive for accuracy, we do not guarantee that these calculations are error-free or perfectly aligned with your local mosque or specific school of thought (Madhab).

  • Verification: You are responsible for verifying the accuracy of prayer times and direction, especially in locations with extreme latitudes or magnetic interference.

  • Not Religious Authority: The content within the App does not constitute a fatwa or official religious ruling.

4. User-Generated Content

If the App allows you to post notes, feedback, or other content ("User Content"):

  • License to Us: You retain ownership of your User Content, but you grant Deen Buddy a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for the purpose of operating and improving the App.

  • Prohibited Content: You agree not to submit content that is illegal, offensive, hate speech, defamatory, or infringes on the rights of others. We reserve the right to remove any content at our sole discretion.

5. Subscriptions and Payments (If Applicable)

If Deen Buddy offers paid features or subscriptions:

  • Billing: Payments are processed through the Apple App Store or Google Play Store ("App Stores"). You agree to their respective terms and conditions regarding payments.

  • Renewals: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period in your device settings.

  • Refunds: Refund requests are handled directly by the App Store or Google Play Store, not by Deen Buddy, in accordance with their refund policies.

6. Prohibited Activities

You agree not to use the App to:

  • Violate any applicable national or international law.

  • Harass, abuse, or harm another person or group.

  • Transmit viruses, malware, or any other code of a destructive nature.

  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, DEEN BUDDY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEEN BUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

  • YOUR USE OR INABILITY TO USE THE APP;

  • ANY ERRORS OR INACCURACIES IN CONTENT (INCLUDING RELIGIOUS DATA);

  • UNAUTHORIZED ACCESS TO OUR SERVERS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE SIX MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Deen Buddy, its affiliates, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the App or your violation of these Terms.

10. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

  • Dispute Resolution: Any dispute arising from these Terms shall be resolved through binding arbitration in [Insert Your City/State], except that you may assert claims in small claims court if your claims qualify. You agree to waive your right to a trial by jury or to participate in a class action lawsuit.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date or sending a notification within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
